These Terms of Use (“Agreement”) apply to Your access to and use of the Mobile Application and the PaintsMe.com Website. Please note that the Agreement may be amended by PaintsMe.com at any time in its sole discretion. If we make changes, we will make the new version of the Agreement available on our Mobile Application and the Website. You will also be sent a push notification to read the new Agreement. We may require you to provide your consent to the updated Agreement in certain ways before further use of the Mobile Application and/or the Website is available. If You do not agree to any changes after being notified of the changes, You must stop using the Services, including the mobile application and website. Otherwise, Your continued use of the Services, including the Mobile Application and/or the Website, constitutes Your acceptance of such changes. User Content

Our Service allows you to create, store, share and otherwise make available content on the PaintsMe.com service. Subject to this Agreement, You are responsible for the Content You post on the Mobile Application and/or the Website. Please note that we may remove User Content at any time and for any reason. PaintsMe.com is not a backup service and you agree that you will not rely on the Services for the purpose of backing up or storing User Content. PaintsMe.com shall not be liable to you for any modification, suspension or discontinuance of the Services or for the loss of any User Content.

Definitions

“Company” means Udrive LLC trading under the name PaintsMe.com. “Website” means a website hosted on the Internet using the domain name www.paintsme.com. “Mobile Application” means an application hosted on the App Store and Google Play using the domain name PaintsMe.com. “Services” means all features provided in the Mobile Application and on the Website. “User” means any person using the Mobile Application and/or Website.

Prohibited behavior and content

When using the PaintsMe.com service, you may not create, post, store or share any User Content that: Is illegal, libelous, defamatory, obscene, pornographic, indecent, depraved, suggestive, harassing, threatening, invasive of privacy or publicity, offensive, inflammatory or fraudulent; May constitute, encourage or instruct the commission of a criminal offense, violate the rights of any party or otherwise create liability or violate any local, state, national or international law; May infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party; Contains any unsolicited advertising, political campaigning, advertisements or solicitations; Contains any private or personal information of third parties without their consent; Contains any viruses, corrupted data or other harmful, inflammatory or destructive files or content; Is, in our sole opinion, unacceptable, restricts or prevents any other person from using or enjoying our Services, or may expose PaintsMe.com or others to any type of damage or liability; In addition, while we are under no obligation to review, edit, or monitor User Content, we may remove User Content at any time and for any reason; You may also only post or otherwise share non-confidential User Content to which you have full rights to disclose.

Intellectual property

All intellectual property in the Services featured on PaintsMe.com is and will remain the exclusive property of PaintsMe.com. Users may use the PaintsMe.com trademarks and trade dress only in accordance with these Terms and may not otherwise use the PaintsMe.com trademarks or trade dress in connection with any product or service without the prior written consent of PaintsMe.com. The User of the Mobile Application and/or the Website has the right to save/share any generated image if its Content is not included in the “Prohibited Behavior and Content” clause.

Third parties

The Service may contain links to third party websites, products or services that are not owned or controlled by PaintsMe.com and your use of or access to the Service may involve your use of, access to or interaction with third party websites, products or services. PaintsMe.com does not control and is not responsible for the content, Privacy Policy, terms of service or use or practices of any third party websites or services. PaintsMe.com makes no warranties regarding the offerings of any third party entity or individual or their websites. You acknowledge and agree that PaintsMe.com shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

Disputes Resolution

In case of a dispute or disagreement related to compliance with the terms of this Agreement, the User and we, as the owners of the PaintsMe.com website, will make every effort to resolve it through negotiations. The Party that has a claim and/or disagreement sends a message to the other Party indicating the claim and/or disagreement that has arisen. The recipient of the claim, within 30 (thirty) calendar days from the date of its receipt, notifies the claimant in writing of the results of the consideration of the claim. If it is impossible to resolve the dispute on a voluntary basis, any of the Parties has the right to apply to the court for the protection of violated rights. Disputes between the User and Yudrive LLC are considered at the location of the contact person of Yudrive LLC.
